Why choose Openedze
What you get when our experts handle this end-to-end
Exclusive brand rights
A registered trademark gives you the sole right to use, license, sell, or franchise your brand across India.
Legal protection
Stop copycats, counterfeiters, and infringers through injunctions and damages under the Trade Marks Act, 1999.
Enforceable in court
Registered trademarks are presumed valid in court — the burden of proof shifts to the infringer.
Marketplace protection
Brand registry on Amazon, Flipkart, and Meesho requires a registered trademark — enabling brand-gated controls.
Foundation for global filings
Indian registration is the priority basis for filings in other countries via the Madrid Protocol.
Use ™ from day one
You can use the ™ symbol from the day of filing. ® can only be used after registration is granted.
What we help with
Trademark search
We search the IP India database and global databases to confirm your mark is registrable before filing.
Class & description selection
Picking the right Nice classification (Class 1–45) is critical — wrong class = wrong scope of protection.
TM-A application filing
Drafted carefully with goods/services description, applicant details, and proof of use (if any).
Examination report response
If the Registrar raises an objection (Section 9 / 11), we draft and file a robust reply within the 30-day window.
Opposition defence
If a third party opposes your mark post-publication, we draft the counter-statement and represent you in opposition proceedings.
Registration & renewal
Once registered, the mark is valid for 10 years — and renewable indefinitely. We track renewal deadlines.
Why trademark registration matters
A trademark is more than a name — it's the legal identity of your brand. Registered trademarks under the Trade Marks Act, 1999 give you a 10-year (indefinitely renewable) statutory right to stop anyone else from using a confusingly similar mark in your category of goods or services.
Unregistered brands rely on common-law 'passing off' protection, which is harder, slower, and more expensive to enforce. A registered mark gives you presumption of ownership, statutory damages, criminal action under Section 103, and access to brand registries on marketplaces like Amazon Brand Registry and Flipkart Brand Plus.
The mistake most founders make: filing late, filing in the wrong class, or skipping the prior-art search. Each of these can cost you months in objections and oppositions — or worse, lose you the rights to your own brand. Our IP team handles each step end-to-end so you get registered cleanly the first time.

Frequently asked questions
How many classes do I need to file in?▾
Each class of goods or services (e.g., apparel = Class 25, software = Class 9, restaurants = Class 43) requires a separate filing. We recommend filing in every class where you commercially use or plan to use the mark within 5 years.
What's the difference between ™ and ®?▾
™ can be used from the day you file the application (or even before, claiming common-law rights). ® can only be used after the trademark is officially registered.
What happens if someone opposes my mark?▾
After publication, third parties have 4 months to oppose. We file a counter-statement, evidence, and represent you at hearings if needed. Most oppositions can be resolved through evidence and negotiation.
Can I register a logo and name together?▾
Yes. A composite (word + device) mark is a single application. But for stronger protection, many brands file the word mark and the logo separately — covering more ground.
How long is registration valid?▾
10 years from the date of filing, renewable indefinitely. We track your renewal deadlines and file before expiry — late renewal attracts heavy penalties.
Are there government fee rebates for startups?▾
Yes. DPIIT-recognised startups, individuals, and small enterprises pay 50% of the standard government fee. We help you check eligibility and apply the rebate.
